The Waterlase Trial Program

Beginning January 1, 2023, through December 31, 2023, licensed practicing dentists who attend a BIOLASE 2023 Waterlase Exclusive Trial Program two-day training event and then purchase a Waterlase iPlus or Waterlase Express during their forty-five (45) day trial period will receive a four-hour BMW Driving Experience to be used during a Waterlase Weekend event (“Gift”). The Waterlase Weekend consists of two (2) nights’ accommodations in Palm Desert-area of California, two (2) dinners, two (2) breakfasts and one (1) lunch meal, round-trip transportation to and from the BMW Performance Center West and the hotel, and a pass to attend the Biolase four-hour BMW Performance Center West Driving Experience. The BMW Driving Experience allows participants to get behind the wheel of multiple BMW automobiles on the BMW track. Participants will receive safety instructions and driving technique tips prior to taking on the Test Tracks. All participants must comply with all venue requirements and sign liability and safety waivers provided by the venue. Participants will also receive a $500 gift card which may be used to help offset transportation for the Gift. Waterlase Weekends are currently anticipated to take place on TBD dates. The Gift is non-transferable and may only be used by the practicing dentist who receives the Gift.

Offer available only to legal U.S. residents residing in the fifty (50) United States and Washington, D.C. who are licensed practicing Dentists. Limited quantity available, while supplies last. Offer void where taxed, prohibited or restricted by law. Offer is sponsored by BIOLASE, Inc. located at 27042 Towne Centre Drive, Suite 270, Foothill Ranch, CA 92610 (“Sponsor”).

A Sponsor representative will contact the recipient to coordinate the Gift.

Limit one (1) Gift per dental practice. Requests received from any participant or practice in excess of the stated limitation will be void. No Gift substitutions will be awarded if Recipient fails to accept, claim or meet eligibility requirements as outlined in these Terms and Conditions. Sponsor reserves the right to substitute available Gifts at any time. Purchases made outside of the Promotion Period, after the participants forty-five (45) day trial period, or outside of BIOLASE 2023 Waterlase Exclusive Trial Program two-day training events are not eligible. Offer cannot be combined with any other offer or discount. Gifts cannot be redeemed for cash or returned for cash refund.

Recipients are solely responsible for any applicable federal, state and local taxes.

Employees of Sponsor, BMW Performance Group, and their respective parent companies, affiliates, subsidiaries, vendors, promotion or advertising agencies (collectively “Released Parties”), or any other person or entity involved with the design, production, execution or distribution of the Offer and the immediate families (spouse, parents, children or siblings, and each of their respective spouses, regardless of where they reside) and household members, whether or not related, of each of the foregoing are ineligible to participate in the Offer or receive a Gift.

All travel dates will be agreed upon between Sponsor and winner. All travel must be made through Sponsor’s agent, on a carrier of Sponsor’s choice. Travel must take place on dates designated by Sponsor, certain restrictions and blackout dates may apply. Travelers must possess all required travel documents, including a valid government issued ID card. All air transportation tickets are subject to the vagaries of flight variation, work stoppages and schedule or route changes. If the closest airport to a recipient’s home is in close enough proximity to destination city so that, as Sponsor may determine in its sole discretion, a flight is unnecessary, such recipient will receive alternate ground transportation from the Sponsor with no further obligation to the recipient. Sponsor reserves the right to structure the travel route and select hotel in its sole discretion.

If recipient is unable to participate in the Gift as described herein, the Gift will be forfeited in its entirety. In the event a recipient is able to participate in the Gift during the dates designated by Sponsor but any portion of the Gift does not or cannot take place as scheduled or at all, for reasons including but not limited to scheduling conflicts, cancellations, postponement, an event of force majeure, or for any other reason, then the Sponsor reserves the right to provide the remainder of the prize with no further obligation to the recipient.

Acceptance of a Gift constitutes Gift recipient’s permission for Sponsor and its designees to use Gift recipient’s name, photograph, likeness, voice, biographical information, statements and address (city and state) for advertising and/or publicity purposes worldwide and in all forms of media now known or hereafter developed, in perpetuity, without further compensation.

Released Parties are not responsible or liable for, and are hereby released from: (i) errors or malfunctions of any kind relating to or in connection with this Offer, including, without limitation, errors or problems which may occur in connection with the administration of the Offer or the processing of Gifts; and (ii) any and all costs, injuries, losses or damages of any kind, including, without limitation, death and bodily injury, due in whole or in part, directly or indirectly, to participation in the Offer, the Gift or any Gift-related activity, or from recipient’s acceptance, receipt, possession and/or use or misuse of any Gift. Released Parties have not made any warranty, representation or guarantee express or implied, in fact or in law, with respect to any Gift, including, without limitation, to such Gift’s quality or fitness for a particular purpose. Sponsor reserves the right in its sole discretion to modify, suspend or terminate the Offer. All materials submitted in connection with this Offer become property of Sponsor and are non-returnable. Forged or fraudulent requests or documents of any kind not obtained through authorized channels will be void. Sponsor has no obligation to acknowledge or redeem any requests that are not in compliance with these Terms and Conditions. Invalid or duplicate requests will not be honored. This Offer is void outside the area stated above and where prohibited.

BY ACCEPTING THE GIFT, RECIPIENT ACCEPTS THE INHERENTLY DANGEROUS NATURE AND RISK IN A DRIVING EXPERIENCE, INCLUDING PERSONAL INJURY AND/OR DEATH, ACKNOWLEDGES THAT HIS/HER PARTICIPATION IN THE GIFT IS VOLUNTARY, ACKNOWLEDGES THAT THERE ARE NATURAL FACTORS AND OCCURRENCES WHICH MAY IMPACT ON OR AFFECT THE SAFETY OF THE ACTIVITIES HE/SHE IS PARTICIPATING IN AND HE/SHE ASSUMES THE RISK OF SUCH FACTORS AND OCCURRENCES AND AGREES THAT RELEASED PARTIES SHALL NOT BE IN ANY WAY RESPONSIBLE FOR ANY RESULTING INJURY AND/OR DEATH.
